Flo Pilates Health Disclaimer

1. Definitions

1.1 “Studio” refers to Flo Pilates & Wellness Studio and its affiliates.
1.2 “Client” means any individual who uses or attempts to use the Studio’s facilities, programs, or services, including but not limited to Reformer Pilates, Mat Pilates, and other wellness services
1.3 “Policies” refer to this Health Disclaimer & Waiver of Liability and the Studio’s related rules and procedures.

2. Assumption of Risk

2.1 Inherent Risks. Clients acknowledge that all Treatments involve inherent risks, including but not limited to:

Musculoskeletal injuries (e.g., strains, sprains, joint injuries, falls) arising from Pilates exercises utilizing specialized equipment; and
Aggravation of pre‑existing conditions.

2.2 Voluntary Participation. Clients voluntarily assume all such risks and agree that the Studio is not liable for injuries, illnesses, or damages resulting therefrom.

3. Health Representations & Medical Clearance

3.1 General Health. Clients represent that they are in good physical condition and free from any medical condition that could be exacerbated by Treatments. Clients shall consult a qualified healthcare professional before participating if they are uncertain of their ability to safely use the Studio’s facilities or services.
3.2 Pregnancy.
3.2.1 Medical Clearance. Pregnant Clients must provide written clearance from their obstetrician or family physician before engaging in any Pilates classes or Treatments.
3.2.2 Disclosure. Pregnant Clients shall inform the Studio and their instructor of their pregnancy status prior to initial and any subsequent sessions.
3.2.3 Restrictions & Modifications. The Studio reserves the right to restrict or modify exercises and to prohibit use of hydro-suite facilities for pregnant Clients to protect both the Client and fetus.

4. Contraindications

4.1 Pilates Exclusion. Clients shall not participate in Pilates exercises if they have:

Uncontrolled cardiovascular or severe respiratory disorders,
Recent surgeries or acute injuries,
Any other condition that contraindicates physical exertion, unless cleared by a healthcare professional.

5. No Medical Advice

Clients acknowledge that the Studio’s staff are not medical professionals. Any information provided by Studio personnel or on its website is for educational purposes only and shall not be construed as medical or therapeutic advice. Clients must seek advice from qualified healthcare providers for any medical concerns.

6. Waiver of Liability

To the fullest extent permitted by law, Clients hereby waive, release, and discharge the Studio, its owners, employees, agents, and affiliates from any and all claims, liabilities, losses, or damages (including legal fees) arising out of or related to use of the Studio’s facilities or services, whether caused by negligence or otherwise.

7. Indemnification

Clients agree to indemnify, defend, and hold harmless the Studio and its representatives from any claims, demands, or actions, including attorney’s fees, resulting from the Client’s breach of these Policies or use of the Studio’s facilities.

8. Compliance with Instructions

Clients shall comply with all posted safety instructions and staff directives. Failure to do so may result in immediate termination of services without refund.

9. Health Transparency

Clients agree to disclose any relevant health conditions or concerns prior to participation. Clients understand that failure to disclose pertinent information may significantly increase the risk of injury or adverse effects, including death. Documented cases in Canada and the United States demonstrate that abrupt temperature changes can cause serious cardiovascular events.

10. Right of Refusal

The Studio reserves the absolute right to refuse service or access to any Client whom the Studio reasonably believes may be at risk of adverse effects from services.

11. Acknowledgment & Entire Agreement

By using the Studio’s facilities, Clients acknowledge that they have read, understood, and agree to be bound by these Policies. These Policies constitute the entire agreement between the Client and the Studio regarding health and safety and supersede all prior representations or agreements.

If you experience any discomfort or unusual symptoms during or after any Treatment, discontinue use immediately and seek medical attention. Your safety is our primary concern.
